The Constitution of Liberty — What Institutions Protect Freedom?

This is NOT an online meeting but an in-person meeting. Meeting in English. Reading the book is not required.

During the book discussion the leader of the discussion presents the most interesting parts of the book. The great emphasis is placed on discussion.

Book Description What kind of political and legal system is necessary for a society to remain free?

In the second part of *[The Constitution of Liberty](https://www.goodreads.com/pl/book/show/1044658.The_Constitution_of_Liberty)*, Friedrich A. Hayek moves from the philosophical foundations of freedom toward the institutions and principles that can protect it. He examines the rule of law, constitutional government, equality before the law, and the limits that should be placed on the exercise of political power.

For Hayek, freedom cannot survive simply because governments intend to respect it. It requires a framework of general and predictable rules that limits arbitrary power and allows individuals to make their own plans. This raises difficult questions about legislation, government intervention, democracy, and the relationship between political majorities and individual liberty.

Hayek is particularly concerned with the danger of governments using apparently legitimate political power to pursue particular outcomes. If laws are designed to achieve specific social or economic goals, can they remain compatible with individual freedom? And how can democratic government be prevented from becoming arbitrary while still remaining accountable to citizens?

At this event, we'll use Hayek's arguments as a starting point for a broader discussion about the rule of law, constitutionalism, democracy, political power, equality before the law, and the institutions required to protect individual freedom.

Discussion Topics

• Why does Hayek consider the rule of law essential to individual freedom? • What is the difference between government acting according to general rules and government pursuing specific social outcomes? • Does equality before the law require treating everyone identically? • When does legislation become an instrument of arbitrary power? • Can a democratic majority legitimately restrict individual freedom? • Should governments be allowed to pursue particular ideas of social or economic justice? • What institutional constraints on political power are necessary in a free society? • Is Hayek's conception of the rule of law still adequate for modern democratic states?
